Montreal, April 16, 2025, NOTICE is hereby given that, as of May 25, 2023, the judgment of the Court of Appeal dated July 13, 2022, has become enforceable. This judgment upheld a class action against the FTQ-Construction Union in case 500-06-000586-111, ordering the defendant FTQ-C to compensate members of both groups for the damages suffered, which include wages paid without work performed and loss of wages or earnings on October 25, 2011, with interest at the legal rate plus the additional indemnity provided for in Article 1619 of the Civil Code of Quebec, calculated from the date the motion for authorization to institute this class action was served. The court also ordered individual recovery.
In a separate proceeding (500-06-001096-201), the defendant Corporation du Conseil provincial du Québec des métiers de la construction (CPQMC) accepted, on November 26, 2024, the conclusions of the Court of Appeal’s judgment dated July 13, 2022.
The court redefined the Groups in both cases as follows:
“All natural and legal persons with no more than fifty (50) employees whose worksite was disrupted or suspended on October 25, 2011,
and
All natural and legal persons with no more than fifty (50) employees who were deprived of remuneration due to the disruptions or closures of worksites that occurred on October 25, 2011.”
Receiving this notice means that, in principle, you may be entitled to compensation. The exact amount of each individual reimbursement is not yet known but is calculable, as it corresponds to lost wages (for construction workers), wages paid without work performed, or lost income (for contractors) due to worksite closures and disruptions on October 25, 2011.
Since the Court of Appeal has ordered individual recovery, you must submit a claim to receive a gross indemnity of up to $500.00 (gross indemnity for 8 hours of lost work) if you were an employee. There is no set cap for contractors who paid wages without work performed or who incurred revenue losses. You may receive a cheque by mail or an Interac e-Transfer via secure email. In either case, processing fees may apply. To complete a claim form, visit www.ftq-inter.ca. Other deductions will be made from the compensation before payment. PLAINTIFFS’ LAWYERS’ FEES
- The court has approved a 35% fee (plus taxes) for the plaintiffs’ lawyers, which will be deducted from the compensation paid to beneficiaries.

- For Second Group members: Was the member forced to leave the construction site? Was the member denied access to the construction site? Was the member prevented from providing their work performance on October 25, 2011?
- For First Group members: Did the member have a legal obligation to pay the wages they are claiming reimbursement for?
