In October 2023, 23andMe identified and disclosed a data security breach affecting customers' personal information, including genetic data and family connections. Canadian customers filed class actions in the Supreme Court of British Columbia alleging damages arising from the incident. The defendants—23andMe, certain of the company's former directors and officers, and auditor KPMG LLP (United States)—deny the allegations, which have not been proven in court. The settlement represents a compromise of disputed claims reached as part of 23andMe's bankruptcy proceedings.

• Customer of 23andMe at any time between May 1, 2023 and October 1, 2023
• Resided in Canada during the data breach period
• Received a notice from 23andMe indicating personal information was compromised
• Did not opt out of the settlement

A settlement totaling US$3.25 million, to be distributed after deduction of court-approved legal fees, administration expenses, and applicable taxes.

Two types of claims were available:

Extraordinary Claims: Up to CA$2,500 per claimant for documented, unreimbursed, out-of-pocket expenses incurred between October 1, 2023 and March 31, 2024, including:

• Unreimbursed costs for physical security or monitoring systems
• Unreimbursed costs for professional mental health counseling or treatment
• Other documented out-of-pocket expenses directly resulting from the breach

If extraordinary claims exceeded available funds, the administrator applied pro-rata reduction. Any surplus was redirected to ordinary claims.

Ordinary Claims: All eligible claimants received an equal pro-rated share of the remaining distribution fund without requirement for documentation or proof.
