Summary

The Superior Court has authorized a class action in punitive damages against Bell Canada regarding contracts concluded for residential telephone, Internet, or television services following door-to-door solicitation or elsewhere than at a Bell Canada establishment:

“All Quebec consumers (individually a ‘Class member’ or collectively the ‘Class members’) who have entered into a subscription contract or subscription renewal contract, during the period from June 23, 2018 until the date of publication of the notices provided for in article 576 (2) C.C.P. in the present case (the ‘Target Period’), for Defendant Bell Canada’s residential telephone services and/or Internet services and/or television services (individually a ‘Service’ or collectively the ‘Services’) through an employee and/or representative of Defendant Bell Canada and/or one of its subcontractors following door-to-door solicitation or elsewhere than at a permanent establishment of Defendant Bell Canada carried out in contravention of the provisions of the Consumer Protection Act, the Regulation respecting the application of the Consumer Protection Act, or the Civil Code of Québec.”

The status of representative for the purpose of the class action was appointed to Marie-Josée Langlois-Vinet.

The Court has not yet ruled on the merits of the class action, nor on any compensation that may be awarded to Class members. Bell Canada denies the allegations of Marie-Josée Langlois-Vinet and contests the merits of the class action.

If you wish to remain a Class member, no action is required from you.

The main issues captured by the class action are the following:

  1. In the course of its door-to-door solicitation activities or elsewhere than at one of its permanent establishments for residential telephone and/or Internet and/or television services, did Defendant Bell Canada, acting through an employee and/or representative of Bell Canada and/or one of its subcontractors, contravene the Consumer Protection Act and/or the Regulation respecting the application of the Consumer Protection Act, including in particular sections 2, 23, 25, 27, 28, 30, 31, 32 or 33 of the said Act and sections 7.1, 50.2, 93 or 94.01 of the Regulation?
  2. In the course of its door-to-door solicitation activities or elsewhere than at one of its permanent establishments for residential telephone and/or Internet and/or television services, did Defendant Bell Canada, acting through an employee and/or representative of Bell Canada and/or one of its subcontractors, contravene the Civil Code of Québec, including in particular sections 6, 7, 1375 and/or 1457 of the Code?
  3. In so doing, has Defendant Bell Canada committed faults giving rise to liability towards the Class members?
  4. Are Class members entitled to punitive damages of $1,000.00 per Class member (to be paid by Bell Canada)?

Another notice will be published when a final judgment is rendered in the class action.
