A judge of the Superior Court of Justice is currently overseeing this case. The case is known as Obodo v. Trans Union of Canada, Inc. CV-19-00631317-00CP. The people who are sued are called the Defendants.

What is the lawsuit about?

The lawsuit states that Trans Union is responsible and owes the plaintiffs damages relating to a Canada-wide data breach of personal and financial information being held by Trans Union that occurred in or around June, 2019 and July, 2019, wherein an unauthorized person or persons gained access to such information of certain consumers whose personal information Trans Union had in its file. The lawsuit pleads that Trans Union facilitated the data breach by negligently failing to protect their customer’s data and information, and that actions or omissions facilitated certain consumers privacy being invaded by this data breach.

Trans Union thereafter advised the affected consumers of the security incident, but the Defendants deny the claims for liability and damages being advanced in this Action. The Plaintiffs lawyers have to prove their case in court.

What is a class action?

In a class action people called the “Representative Plaintiffs”: (in this case Michael Obodo) sued on behalf of persons who have similar claims. All of these people are a “Class” or “Class Members”. The court resolves issues for all class members in one case, except for those who remove themselves from the class.

Who is a member of the class?

The Class includes:

All persons (i) who reside in Canada; (ii) whose personal information was provided to or otherwise obtained by the Defendant, which information may include but is not limited to their name, date of birth, current address, past addresses, social insurance number, and information relating to credit and loan obligations and the entities to whom these obligations are owed; and (iii) who were sent a notice letter by the Defendant about the 2019 data breach.

What is the Plaintiff asking for?

The Plaintiff is asking for money or other benefits for the Class. He is also asking for lawyers’ fees and costs plus interest.

Is there any money available now?

No money or benefits are available now because the court has not yet decided whether the Defendant did anything wrong and the two sides have not settled the case. There is no guarantee that money or benefits will ever be obtained. If there are, you will be notified about how to ask for your share.

What happens if I do nothing?

If you do nothing you will automatically remain in the lawsuit. You will be bound by all Court orders. If any benefits are awarded, you may need to take action in order to receive any benefits.
